Ukrzaliznytsia advised to change tender conditions after complaint from Bankers Association

The Antimonopoly Committee recommended that Ukrzaliznytsia change the terms of tenders following a complaint from the Bankers Association. This was reported by the head of the AMCU, Pavlo Kyrylenko.

The Antimonopoly Committee provided Ukrzaliznytsia with mandatory recommendations for consideration on the terms of tenders after the complaint of the Association of Ukrainian Banks on the actions of UZ and its structural divisions.

We are talking about the practice of establishing separate, conditions for tender participants not provided for by law.

In particular, the tender documentation sets out requirements according to which bank guarantees can only be issued by banks with certain ratings and indicators.

“These requirements lead to the fact that out of hundreds of banking institutions licensed by the National Bank to carry out such activities, only 19 can participate in the relevant tenders of Ukrzaliznytsia,” Kyrylenko noted.

It is reported that the Antimonopoly Committee, by its decision, recommended that Ukrzaliznytsia reconsider this practice and comply with the principles of free competition and competition law standards.

Ukrzaliznytsia must notify the Committee of the consideration of these recommendations and the measures taken within 30 days from the date of their receipt.
