Dismissal of military personnel: what is proposed in the Rada

Supreme The Rada may dismiss military personnel after 36 months of service.

Bill 11460 on permission to dismiss military personnel from military service in the event of continuous service during martial law for 36 months, of which at least 18 months were spent directly participating in combat missions, has been submitted to the Verkhovna Rada.

It is noted that the grounds and terms of dismissal are proposed to be determined by the Decree of the President. Such persons cannot be called up for military service during mobilization for 12 months from the date of dismissal from military service to the reserve, unless they have expressed a desire to continue military service.

It is also proposed to dismiss military personnel who served in continuous conscription during mobilization during martial law from military service into the reserve in accordance with the Presidential Decree upon reaching 36 months of service.

Of which at least 18 months they took direct part in the performance of combat missions determined by combat orders or instructions. Such persons may not be called up for military service during mobilization for 12 months from the date of discharge from military service to the reserve, unless they have expressed a desire to continue military service.

The deputies propose to establish that such persons may be called up for military service during the specified period with their voluntary written consent. In the event of such consent to extend military service beyond the 36-month period of service, the monetary payments established by law to such servicemen are paid in double the amount.

In addition, it is proposed to establish that during martial law, servicemen voluntarily accepted for military service (under contract), who have chosen the corresponding branch of the armed forces (forces) and a specific unit (military unit) of the Armed Forces of Ukraine, other military formations as the place of its passage, cannot be transferred to other military units (subdivisions) of another branch of the armed forces (forces) of the Armed Forces of Ukraine, other types of military formations without their voluntary written consent.
