Ukraine May Start Depriving People of Land Rights: New Initiative from the Cabinet of Ministers

Under martial law, the Ukrainian government continues develop and implement mechanisms necessary for prompt response to security challenges.

This was reported by URA-Inform with reference to the Telegram channel of the Permanent Representative of the Cabinet of Ministers in the Verkhovna Rada Taras Melnychuk.

One of the key steps was the proposal of the Cabinet of Ministers to introduce a procedure for the forced temporary deprivation of the right to use land plots for the construction of military facilities. The corresponding bill has already been approved at the government level and will soon be submitted to the Verkhovna Rada for consideration.

According to the statement, the proposed changes are aimed at meeting defense needs through the efficient use of land resources. The bill provides for:

This document will serve as the legal basis for restricting rights to a plot of land for the duration of military tasks. It will include a description of the plot, the purpose of its use and the period of restriction.

Determination of the procedure for terminating restrictions

Upon completion of construction or after the lifting of martial law, a special commission will decide on the return of the plot of land to the owner or the transition to the buyout/alienation procedure.

Buyout or compulsory alienation procedures

If the state requires the land on a permanent basis, the owner will be offered compensation at market value. In the absence of consent, the alienation procedure will be carried out in court.
