Lawyers from the INSEININ law firm reminded that failure to comply with military registration rules or evasion of mobilization is considered an administrative violation.
This was reported by URA-Inform with reference to Inseinin.
Fines are provided for such actions.
When a fine comes
Legal experts note that an administrative penalty for an offense can be collected within 3 months from the moment the violation is detected, but no later than a year from the date of its commission.
When a citizen fails to appear when summoned or violates other TCC requirements, the process of imposing a fine takes place in several stages:
Recording the violation
First, TCC employees must record the fact of the violation (for example, failure to appear when summoned). This may happen after the citizen fails to appear at a certain time without good reason or a registered letter is returned from Ukrposhta.
Consideration of the case
After the resolution is drawn up by the TCC and SP authorized to consider such cases, a decision is made on the requirements of Resolution 560.
Making a decision
The TCC and SP which considers the case of an administrative offense and makes a decision to impose a fine.
Deadline for execution of the decision
After the decision is made, the citizen is sent a letter notifying about the need to pay the fine. This usually happens 5-10 business days after the case is considered. If the citizen does not pay the fine voluntarily, a procedure for forced collection can be initiated, which is carried out through the enforcement service.
What affects the deadlines
Lawyers say that in different regions of Ukraine, the deadlines for considering cases can vary significantly. In some cases, the process can take from several days to several weeks, depending on the workload of the territorial recruitment centers.
It also became known under what conditions a summons is considered undelivered: a lawyer warned Ukrainians.
