Can the shopping center enter a yard or house without the owner's consent?
Lawyers clearly state that representatives of the TCC cannot enter the courtyard of a private home, apartment or other premises belonging to a citizen without permission. They do have the right to visit conscripts and check documents, but access to private territory is possible only with the consent of the owner.
According to Article 233 of the Criminal Procedure Code, no one has the right to enter private property without legal grounds. The only exception may be a court decision that authorizes such access.
“A residential area is any place where a person lives on a permanent or temporary basis, regardless of its purpose,” lawyers explain.
Can the TCC enter private property together with the police?
Police officers also cannot freely enter private property. However, they have the right to do so if there is a threat to a person's life or health, illegal actions are taking place, or there is a corresponding court order.
In the event of an emergency entry, police officers are required to draw up an official report recording the grounds for entry.
Thus, TCC employees do not have the right to enter private territory without permission, and citizens can demand that their rights be respected within the framework of the law.
