Ombudsman: Volyn TCC violated citizens' right to legal assistance

The recruitment center decided that they would not allow lawyers to participate in the mobilization and medical examination processes.

Lubinets commented on his Telegram page on the statement of the Volyn Regional Territorial Recruitment and Social Support Center that lawyers are “superfluous” in processes related to mobilization.

According to the ombudsman, Article 59 of the Constitution of Ukraine guarantees the right for professional legal assistance, which cannot be stopped even during martial law. Mr. Lubinets recalled that lawyers are allowed even into places of detention, so the TCC had no authority to impose any bans.

Yulia Spas, a representative of the authorized representative in the Volyn region, sent a letter to the Volyn TCC “in order to clarify and prevent violations of the rights of citizens.”

The situation was also commented on by the National Academy of Advocacy of Ukraine: Igor Kolesnikov, deputy chairman of the relevant committee, sees in the actions of the TCC signs of a crime under Article 397 of the Criminal Code – interference in the activities of a defense attorney or representative of a person.
