The Cabinet of Ministers recently approved changes to the procedure for reserving military personnel from mobilization, and also allowed enterprises that have not yet managed to confirm the criticality and re-reserve their employees to do so until March 31. Until this date, the “reservation” of employees of such enterprises will remain in effect.
RBC-Ukraine has compiled the main innovations in the material below.
Main innovations:
Quick cancellation of deferments . Now they can be cancelled once every 5 days, instead of once a month.
Accounting for mobilized personnel . When calculating the permitted booking volumes, those mobilized after May 18, 2024 will be taken into account.
Updated approaches to salary calculation . Due to the transition to monthly reporting, the average salary of an enterprise will now be calculated for the last calendar month, not for a quarter.
Automatic salary check . The Pension Fund and the Ministry of Digital Development must establish electronic data exchange within a month to automatically check whether employees' salaries (from 20 thousand hryvnia) comply with the booking requirements.
Important: you can submit an application for employee reservation only through the Diia portal. This means that business leaders no longer need to issue paper orders – the process takes place entirely electronically.
However, if the employee has already been booked, the previous booking must be cancelled before submitting a new application.
How to apply for employee reservation via “Diyu”:
- Log in to the “Diya” portal.
- Select the “Employee Reservation” service and click “Submit Application”.
- Enter the required employee data.
- Confirm their salary level.
- Check the application and sign it (this must be done by the head of the enterprise or an authorized signatory).
- Wait for the result – a message about the application review will be sent to your email and to the “Diya” portal.
A confirmed reservation will be displayed in the Reserve+ app. If the reservation is provided after the criticality status has been updated, it will be valid for the criticality period – up to 1 year.
Critical business status can be granted to companies that meet three criteria set by the government. Two of them are mandatory:
- the average salary of employees is not less than 20,000 UAH;
- no outstanding tax arrears and unified social contribution.
The third criterion the enterprise can choose one of the following:
- payment of taxes and fees in excess of 1.5 million euros per year (equivalent in hryvnia);
- foreign exchange earnings of more than 32 million euros per year (excluding loans and credits);
- strategic importance for the economy and security of the state (defined by the government list, PKMU No. 83 of 04.03.2015);
- significant significance for a particular sector of the economy or territorial community (criteria are determined by the relevant government agencies, OVA);
- Diya.City resident status;
- supply of electronic communications services with a certain level of income.
How to obtain the status of a critical enterprise:
- Determine the relevant authority (Ministry of Energy, Ministry of Digital Development, Ministry of Agrarian Policy, etc.).
- Prepare and submit documents (financial reports, salary certificates and tax compliance statements).
- Submit an application to the relevant authority and wait for a decision (up to 10 working days).
- Get official confirmation.
Let us recall that in the fall of 2024, following reports of an abnormal increase in the number of critical enterprises and reserved workers, the government conducted an audit of enterprises that have the right to reserve their workers.
According to Prime Minister Denys Shmyhal, “the inspection revealed a number of problematic issues,” but he did not provide details.
On the same day, the government decided to change the criteria for reserving workers from mobilization. The criteria for determining the criticality of enterprises were also updated. In particular, they stipulate that regional and industry criteria for the criticality of enterprises will be agreed with the Ministry of Defense and the Ministry of Economy.
Thus, for those who already had a “reservation”, a transition period to the new conditions was introduced until February 28, so that by this date all enterprises would resume the reservation of their employees according to the new conditions, regardless of how and when it occurred.
However, the Cabinet of Ministers recently extended the deadline until March 31 at a meeting. As Shmygal explained, this decision was made due to a large-scale Russian cyberattack on Ukrainian registries. As a result of the targeted attack, the work of state registries was temporarily suspended, in particular, some services did not work in the Diia application.

Currently in Ukraine 900-950 thousand military-liable citizens have a “reservation” from mobilization.
