Class action lawsuit against Ferrari due to brake failure

Seven owners of Italian supercars have joined forces to sue Ferrari for compensation. The reason is brake failure on almost all Ferrari models from the late 2000s to the early 2020s.

This was reported by RBC-Ukraine with reference to Carscoops.

The plaintiffs claim that although the automaker initiated a global recall campaign for the problematic vehicles, in reality the problems were never resolved, which directly threatens safety.

The legal battle has been going on since late 2022, when the plaintiffs sued Ferrari independently for the first time. The most high-profile incident involved a brake failure on a 488 GTB supercar, which forced owner Jeffrey Rose to jump out of the car while it was moving, and sent the Ferrari rolling into a pond and sinking. The victim claims that the brakes stopped working altogether, meaning both circuits failed.

The Italian brand insists that the whole problem is in the defective cap of the brake fluid reservoir: it did not provide sufficient tightness, which is why the system was taking in air. However, the plaintiffs claim that the Ferrari had leaking rear seals of the brake master cylinder, which was why the brake fluid level dropped. However, the brake cylinders were not replaced during the campaign.

So far, the judge has dismissed the class action lawsuit, but apparently for technical reasons: the victims have the right to appeal. In addition to the aforementioned owner of the Ferrari 488 GTB, the case also involves owners of the F430 Spider, California T, and 458 Italia. In total, the brake problem affected more than 20 supercar models, including limited-edition special editions.
