This year, the minimum amount of child support for children under 6 years old is almost 1300 UAH.
InUkrainein 2024, the amount of alimony changed as the cost of living increased.
This was reported by the press service of the Ministry of Justice of Ukraine.
As explained in the department, the minimum guaranteed amount of alimony is as follows:
- for children under 6 years old – 1,281.5 hryvnia
- for children from 6 to 18 years old – 1,598 hryvnia
At the same time, the maximum amount of alimony cannot be higher than ten subsistence minimums. So, for children under 6 years old it is 25,630 hryvnia. For children from 6 to 18 years old – 31,960 hryvnia.
How is alimony payment calculated
The following scheme is used for this:
- for one child – 1/4 of income
- for two – 1/3 of income
- for three or more – 1/2 of income
If the alimony payer has a sufficient level of income, then the court will set the minimum recommended level of alimony for one child in the amount of 100% of the subsistence level for the child, taking into account his age. But parents can agree to pay a larger amount of child support. To do this, you need to write down all the conditions and amount in the contract, and the document will be certified by a notary.
Is it possible not to pay alimony during martial law?
Martial law is not relieves the obligation to pay child support. Even if the payer officially does not have any income, for example, employment relations with him are temporarily suspended.
At the same time, for the period of martial law, the following relaxations apply:
- collection of wages, pensions, scholarships and other income of the debtor are temporarily not subject to forced collection (exception – debtors who are citizens of Russia)
- terms of enforcement proceedings are interrupted and established from the day of termination or cancellation of martial law
- enforcement proceedings and the adoption of measures for the enforcement of decisions in the territories of administrative-territorial units, temporarily occupied by Russia are not carried out during the period of such occupation
However, in any case, the accrual and collection of penalties for late payment of alimony remains. Thus, even in the absence of penalties during martial law, unpaid amounts of alimony accumulate as a debt along with penalties, which will then have to be paid.
