We are talking about the tax liability for the so-called "excess" area.
In the first half of 2025, the State Tax Service must notify real estate owners about the need to pay taxes for the previous year.
Who will receive such messages, what amounts and by what time must be paid, and what will happen if you ignore the payment, TSN.ua figured out.
Who should pay
The notice of the need to pay the property tax must be received by the owners of the property by July 1, 2025. This concerns the tax liability for the so-called “excess” area, exceeding the tax base.
The tax base of a residential property is:
- for an apartment – 60 sq. m.;
- for a residential building – 120 sq. m.;
- for different types of residential property – 180 sq. m.
If the property includes an apartment or a house (or an apartment and a house), the area of which does not exceed the base, then the tax is not charged.
In this case, not the entire area of the housing that is owned is taxed, but only that which exceeds the dimensions established by law.
For example, if a citizen owns an apartment with an area of 85 square meters, then he must pay tax only for the extra 25 square meters.
How much do you have to pay
The property tax is set by decision of the village, town or city council in an amount not exceeding 1.5% of the minimum wage established by law on January 1 of the reporting year, i.e. 2024, per 1 square meter of the tax base.
Since on 01.01.2024 the minimum wage was 7100 UAH, the maximum tax rate should not exceed 106.5 UAH per square meter.
Information on the tax rate can be found directly in the local council or on its official website.
If the local authorities in the region where the property is located have adopted a rate of, for example, 100.5 UAH per meter, then the owner of an 85 sq.m. apartment will receive a notice from the tax office about the need to pay 2,512.5 UAH for the “extra” 25 sq.m.
Who can avoid paying
Some local authorities have not only set their own real estate tax rate, but have also increased the maximum area of objects that are exempt from taxation.
In addition, there are statements of a list of real estate objects that are not subject to taxation.
To find out the rules for paying real estate tax or benefits, you should contact your local government or study the information published by local authorities on official websites and social networks.
Citizens-migrants who have real estate in the occupied territory, or those citizens whose property was destroyed as a result of Russian aggression, do not need to pay real estate tax.
What happens if you do not pay
The recipient of a notice from the tax authority must pay the tax within 60 days of receipt.
If the payment is delayed for up to 30 calendar days, a penalty of 5% of the tax debt is applied; if the payment is delayed for more than 30 days, 10% of the debt is applied.
That is, if a citizen must pay, for example, 2,000 hryvnias of tax, then if the payment is not made on time for more than 30 days after the maximum 60 days established by law, the debt will amount to 2,200 hryvnias.
If the tax is not paid on time, then after the deadline for its payment has expired, a penalty will be charged on the debt at the rate of 120% per annum of the NBU rate in effect on the day the tax debt arose.
Tax authorities have the right to go to court with a claim to collect the amount of the taxpayer's tax debt. Collection of tax debt by court decision is carried out by the state enforcement service.
