Head of the Tax Committee Verkhovna Rada member Danylo Getmantsev believes that the parliament was forced to raise taxes “retroactively” by the “exceptional circumstances”.

However, he points out that this is indeed a “bad solution”.
“In September-October we were faced with a dilemma: either we put the law into effect in November and raise the rates even more (since the amount of the need does not disappear), or we do it on October 1. Well, of these two very, very bad decisions, we chose the one that seemed less bad to us,” he noted.
Getmantsev emphasized that he did not want legal discussions, because they discredit him.
«Why? Because I am a doctor of law and I know for sure that this is a violation. That is, you shouldn't do this,— the MP added.
At the same time, according to him, if we remove the question of constitutionality or unconstitutionality, then the law is constitutional.
«There is a decision by which the Constitutional Court interpreted what retroactive effect means. And he noted that this applies to those cases when the norms regulate relations that began and ended before the date of entry into force of the norm. If we are talking about the third or fourth quarter, then the relations are definitely not completed. But in fact, this is a bad decision. That is, we have no discussion here,», — emphasized the chairman of the tax committee of the Verkhovna Rada of Ukraine.
