An appeals court upheld the life sentence of a conscript who shot his comrades at a factory in Dnepr

The appellate court upheld the life sentence of the conscript who shot his goods> </p> <p>The Dnipro appellate court upheld the sentence—life imprisonment—for the serviceman who shot National Guard soldiers at the Yuzhmash plant in early 2022.</p> <p>The State Bureau of Investigation reports that in April 2024, the Krasnogvardeisky District Court of the city of Dnepr sentenced a conscript to life imprisonment for opening fire at the Southern Machine-Building Plant in January 2022. </p> <p>As a result, 5 people were killed, including one civilian, and 5 more were injured to varying degrees of severity.</p> <p>At the trial, the man fully admitted his guilt, repented, and apologized to the relatives of the deceased. .</p> <p>During the State Bureau of Investigation, it was established that during his military service, the convict had a conflict with other military personnel. He witnessed several quarrels, which he reported to his superiors.</p> <p>Therefore, other soldiers developed a negative attitude towards him. After another verbal dispute, he decided to kill those who did not share his opinions and views. While in the weapons storage room, he took a machine gun and cartridges and began to brutally shoot people. After the massacre, the accused seized the machine gun, 200 cartridges for it and tried to escape. A few hours later, he was detained in the city of Podgorodnoye, Dniprovsky district.</p> <p>As part of the criminal proceedings, dozens of examinations were conducted, including a comprehensive inpatient psychological and psychiatric examination, which established that the soldier had no mental disorders and acted consciously.</p> <p>Thus, the court found him guilty of:< /p> </p> <ul> <li>illegal handling of weapons, that is, carrying and storing firearms, ammunition without the permission provided by law (Part 1 of Article 263 of the Criminal Code of Ukraine);</li> <li>violation of the statutory rules of relationships between military personnel in the absence of a subordination relationship, committed against several persons, with the use of weapons, which entailed grave consequences (Part 3 of Article 406 of the Criminal Code of Ukraine);</li> <li>desertion (Part 3 of Article 408 of the Criminal Code of Ukraine);</li> <li>theft by a serviceman of weapons, ammunition, other military property, committed in the conditions of a special period, except for martial law (Part 3 of Article 410 of the Criminal Code of Ukraine);</li> <li>violation of the statutory rules of guard duty, which entailed grave consequences, for the prevention of which this guard was appointed, committed in the conditions of a special period, except for martial law (Part 2 of Article 418 of the Criminal Code of Ukraine);</li> <li>a completed attempt at premeditated murder of two or more persons, of a person in connection with the performance of his official duty, as well as for the purpose of concealing another crime or facilitating its commission (Part 2 of Article .15, paragraphs 1, 8, 9, part 2, article 115 of the Criminal Code of Ukraine); (paragraphs 1, 8, 9, part 2, article 115 of the Criminal Code of Ukraine).</li> </ul> <p>The punishment is life imprisonment, and the convicted person is also obliged to compensate the civil claims of the relatives of the deceased.</p> <p><!--noindex--></p> <p><a rel=lb.ua
