Court dismisses Musk's lawsuits against OpenAI and Microsoft

A federal court in Northern California has rejected Elon Musk's request for an immediate ban on the commercialization of OpenAI. As reported by IZ with reference to Bloomberg, the judge said that Musk did not provide enough evidence for immediate restrictions, although she agreed to hold an expedited trial of the case later this year. Musk also accused OpenAI and Microsoft of preventing investors from funding competitors, but this lawsuit was also dismissed.

The judge also dismissed Musk's allegations against OpenAI executives that they violated the company's mission and terminated its contract with him in 2018. She noted that the company acted within its rights and warned investors that access to trade secrets would be terminated if it funded competitors. OpenAI is currently continuing negotiations for full commercialization, which involves reorganizing its structure.

Although the court refused to grant an immediate injunction, the case is scheduled for expedited hearing on public interest grounds. Elon Musk argues that the transformation of OpenAI into a for-profit company could cause harm if it is carried out in violation of the law. However, the judge emphasized that this is a purely private investment, not public funds, so the issue requires further consideration.
