In Ukraine, the law stipulates that adult children must provide financial assistance to their parents if they need it. If a child refuses to support their parents voluntarily, the latter have the right to go to court to collect alimony for their maintenance, writes IZ. This was reported by the Coordination Center for the Provision of Legal Aid.
In order to go to court and collect child support, it is necessary that the parents are unable to work, that is, have reached retirement age or have a disability. There must also be a need for financial assistance, and there must be a blood relationship between the parents and the children. In addition, the child must be able to provide assistance.
When determining the amount of child support, the court takes into account the financial situation of both the parents and the children. In particular, important factors are the parents' income and the presence of income-generating assets. It also considers the possibility of receiving assistance from other children or family members, including a spouse.
It is important that children can be released from the obligation to support their parents if it is proven that the parents have evaded their obligations or paid alimony.
