The court verdict dated February 12, 2024, passed by the Vinnytsia Court of Appeal, reveals the story of a conscript who twice evaded mobilization by appearing at the military registration and enlistment office in a special condition.

It is noted that the man came to the TCC in a state of alcoholic intoxication. According to the data from the verdict, a young man living in the town of Lipovets was found fit for military service upon mobilization and received a summons to be sent to a military unit.
However, his appearance at the military registration and enlistment office took an unexpected turn. When the transport arrived to send the mobilized, the man decided not to waste time and, leaving the bus, drank alcohol, as a result of which he returned drunk.
Given the ban on sending military personnel while intoxicated, representatives of the Territorial Command Center made a decision reschedule the summons to another date.
Subsequently, when the young man appeared at the military registration and enlistment office on time, he was again found intoxicated. After this, the case reached the court, which acquitted the man liable for military service in the first verdict, considering his guilt not proven.
However, the appellate court changed the decision of the first instance, finding the man guilty and sentencing him to a three-year prison term.
< p>Taking into account the lack of a criminal record, good reputation and sincere repentance, the court decided to apply a probation measure for three years, instead of a real prison sentence.
