Investigators from the Pechersk Police Department have begun criminal proceedings under two articles of the Criminal Code of Ukraine.

<p>On the Naberezhnoe Highway in Kyiv, an accident occurred on an attraction – a person fell into the Dnieper due to a break in the attraction cable, reports the Kyiv City State Administration.</p>
<p>At first it was reported that a girl fell into the river, later it became known that this is a guy.</p>
<p>The rescue and search operation continues, to which special equipment and boats with divers from the State Emergency Service of Ukraine are involved.</p>
<p>According to the Kyiv Patrol Police, due to the accident, traffic movement on Naberezhnoe Highway is difficult.</p>
<p>“The city is appealing and will demand that law enforcement officers thoroughly investigate both the emergency situation itself and the activities of the company operating the attraction, which opened in 2021 year,” the message says.</p>

<p>The Kyiv police reported that information about the accident was received by the police at about 14:00.</p>

<p><b>Updated.</b> Later it became known that, according to information available to the police, a 20-year-old guy was on the attraction at the time of the tragic incident. The search for him continues.</p>
<p>As a result of this event, investigators from the Pechersk Police Department opened criminal proceedings under two articles of the Criminal Code of Ukraine.</p>
<p>In particular, we are talking about a violation of safety rules by a person who is obliged to comply with them, if this violation created a threat of death – Part 2 of Art. 272 of the Criminal Code of Ukraine and official negligence resulting in the death of a person – Part 3 of Art. 367 of the Criminal Code of Ukraine.</p>
<p>The police continue to work at the scene, all circumstances are being established. </p>
<p><b>Update 22.00. </b>The main department of the State Emergency Service of Ukraine in Kyiv stated that as of 21.25, search and rescue operations were completed, but no body was found. </p>
<p>“The diving and rescue department of the State Emergency Service examined 8,000 square meters of the river bottom during dives, as well as 12,000 square meters using an echo sounder. The work will continue tomorrow, in agreement with the National Police,” the rescuers added.</p>

<p>In January 2021, the Kyiv City State Administration reported that the winner of the investment competition to attract investors to the implementation of the project “Establishment of a rope crossing attraction across the Dnieper River from the People's Friendship Arch to Trukhanov Island” was Active LLC country.”</p>
<p>The customer of the cable car project was the public utility company “Pleso”. Its total cost is approximately 3.6 million hryvnia.</p>
<p>The Kyiv City Prosecutor's Office states that prosecutors tried to stop the operation of this attraction back in 2021 by filing a lawsuit with the Economic Court of Kyiv. In it, the prosecutor's office asked to recognize as illegal and cancel the order of the Executive Body of the Kyiv City Council (KCCA) dated January 11, 2021, which recognized “Active Country” as the winner of the investment competition. The prosecutor's office noted that this company had no experience in implementing similar projects and no experience in operating attractions of this type, given their potential danger to life and health. The defendants in the case were the Executive Body, KP “PLESO” and the LLC winner of the competition.</p>
<p>However, the Economic Court of Kyiv, by its decision dated December 2, 2021, refused to satisfy the claim. This decision was upheld by the decision of the Northern Economic Court of Appeal dated June 16, 2022 and the decision of the Supreme Court dated September 14, 2022. The courts and defendants represented by capital officials did not agree with the position of the prosecutor’s office that the cable car across the Dnieper is a high-risk attraction. Also during the trial, it was established that at the time of the investment competition and the trial, the design and technical documentation for the attraction had not been developed.</p>
<p>“However, none of the officials of the Kyiv City State Administration who held the competition to determine the winner were concerned about this until today’s tragic incident. KCSA officials who “demand a thorough investigation from law enforcement officers” are reminded of their position in the courts,” says the press release from the prosecutor’s office.</p>
