Will Smith Sued by Former Tour Violinist for Wrongful Termination and Harassment

Former tour violinist Brian King Joseph sues Will Smith for wrongful termination, sexual harassment, and seeks compensatory damages following 2025 tour.

A former violinist and crew member, Brian King Joseph, has filed a lawsuit against actor and musician Will Smith and his touring company, alleging wrongful termination and sexual harassment, reports Baltimore Chronicle with reference to the original complaint filed in Los Angeles County Superior Court.

Joseph, who toured with Smith in 2025, claims in his court filing that he was dismissed after reporting workplace safety concerns. According to the complaint, Joseph reported an incident in which an unknown person allegedly entered his hotel room in Las Vegas without permission during the tour and left a handwritten note along with several personal items, including a red backpack, a beer bottle, hospital discharge paperwork for another individual, HIV medication labeled with a different name, wipes, and an earring. The note allegedly stated, “Brian, I’ll be back no later [sic] 5:30, just us (drawn heart), Stone F.”

Joseph stated that he alerted both Smith and the touring company, as well as hotel authorities and a local non-emergency police line, fearing a sexual assault could occur if the intruder returned. He further alleges that only a few days after notifying Smith’s team, he was fired from his role on the tour and accused of fabricating the incident. Another violinist was reportedly hired to replace him.

The complaint also alleges that Smith engaged in conduct that “deliberately groomed and primed [Joseph] for further sexual exploitation,” which Joseph described as indicative of “a pattern of predatory behavior.” Joseph claims he has suffered PTSD and other mental health issues as a result of the termination. He is seeking a jury trial, compensatory damages, attorney’s fees, and other relief deemed appropriate by the court.

Allen B. Grodsky, attorney for Will Smith, responded to the allegations, calling them “false, baseless, and reckless,” and stated that they are “categorically denied” and that the legal team will pursue all means necessary to ensure the truth is revealed.

Will Smith conducted a worldwide tour in 2025 to promote his album Based on a True Story, released in March of the same year. The tour included stops in Las Vegas during the month of March, where the alleged incidents took place.
